本报讯 (记者廖丰)空难造成伤者事业遭受损失，航空公司是否应予赔偿？上周末，去年8·24伊春空难生还者关先生与当时的承运人河南航空有限公司及其控股公司深圳航空有限公司相关负责人进行谈判，就其因空难造成的养虾事业亏损索赔260万元。记者昨天获悉，若上述赔偿事项在一周内“谈不拢”，双方将对簿公堂。
关先生是山东东营市海水养殖承包经营户，他告诉本报记者，自己在2009年末和2010年初承包了460亩虾池，“在2010年8月24日以前，我养的对虾长势良好，但我在坠机中受伤后，虾因无人照料死亡，包括前期投入及按当年预计收成计算的损失，总额大概是260万元。”关先生向记者出示了其去年告知河南航空养虾损失一事后，对方于当年9月22日给他的回复。在回复中，河南航空表示：“根据民航法律规定，我公司仅对您的人身伤害承担赔偿责任，对虾死亡的经济损失不属于法定赔偿项目。”值得一提的是，关先生提出的“事业损失费”索赔在国内尚属首例。
上周末，河南航空及深航相关负责人与关先生进行了当面谈判。航空公司方面表示，目前公司对空难中遇难者家属的赔偿工作已接近尾声，对生还者的赔偿也陆续展开，但“事业损失费”这类索赔要求还是头一次遇到，必须就此事请示公司高层及法律团队，一周左右再给予答复。关先生表示，若一周内双方不能对赔偿问题达成共识，他将提起诉讼。
2010年8月24日，河南航空从哈尔滨飞往伊春的一架E190客机在伊春机场降落过程中坠毁。生还者之一的关先生在事故中皮肤和呼吸道均被烧伤。
